Acceptance of these terms

These Terms of Service ("Terms") are an agreement between you and AERSOMA LLC ("AERSŌMA", "we", "us") covering the AERSŌMA app, the AERSŌMA Plus subscription, and the AERSŌMA device. By creating an account or using the app you accept these Terms and the Privacy Policy. If you do not accept them, do not use the app.

Health and safety

AERSŌMA is a wellness and relaxation tool. It is not a medical device. It does not diagnose, treat, cure, or prevent any disease or condition, and it is not a substitute for advice from a qualified professional.

Some practices use paced breathing, and some use breath holds or rapid breathing. These can make you light-headed.

• Do not use AERSŌMA while driving, cycling, operating machinery, or in or near water.
• Talk to a doctor first if you are pregnant, or have a cardiovascular condition, a respiratory condition, epilepsy, low blood pressure, or any other health concern.
• Stop straight away if you feel dizzy, faint, or unwell, and breathe normally.

Advanced practices ask you to confirm that you have read their safety notes before they start. That confirmation is a safety step, not a formality, and you take part at your own risk.

Accounts and eligibility

You must be at least 13, or older where your country requires it, and able to enter a binding agreement. Keep your credentials to yourself; you are responsible for what happens under your account. Tell us if you think someone else has access to it.

What the service includes

The app gives you guided breathing sessions, a catalogue of patterns and protocols, a builder for making your own, a record of what you have practised, shared rooms, and the Global Rhythm. The core of the app is free and does not require payment to breathe.

The AERSŌMA device is separate hardware, sold separately, that leads the same rhythms with gentle vibration. Features change over time; we may add, alter, or retire them.

AERSŌMA Plus

AERSŌMA Plus is an optional paid subscription that unlocks multi-week programmes and an unlimited builder. Safety information, calibration, your own data, and the free catalogue are never behind it.

• Billing. You buy Plus through the App Store or Google Play, and they take the payment under their own terms. We never see your card.
• Renewal. Plus renews automatically at the end of each period unless you cancel at least 24 hours before it ends. Your account is charged by the store on renewal.
• Cancelling. Cancel in your Apple or Google account settings. Cancelling stops the next renewal; you keep Plus until the end of the period you have paid for.
• Refunds. Refunds are handled by the store you bought from, under its policy, not by us.
• Price changes. If we change the price we will tell you in advance, and the store will ask for your agreement where its rules require it.
• If a payment fails, the store may retry and Plus may pause. We restore access as soon as the store tells us the subscription is active again.

Community guidelines

Anywhere you can be seen by other people - your display name, your AERSŌMA ID, room names, and lobby chat - you must not:

• harass, threaten, bully, or abuse anyone;
• post hateful, sexually explicit, violent, or otherwise objectionable content;
• impersonate another person or misrepresent who you are;
• spam, scrape, probe, or try to disrupt or gain unauthorised access to the service.

You can block and report any user or message from inside the app. We review reports and act on them, normally within 24 hours, and we remove content and suspend or end accounts that break these rules. There is no tolerance for abusive or objectionable content.

Your content

The patterns and protocols you build stay yours. You give us a worldwide, non-exclusive, royalty-free licence to store and display that content only as far as running the service requires - for example showing a room you host to the friends you invited. We do not use your content to promote AERSŌMA without asking you.

You are responsible for what you submit, and you confirm you have the right to submit it.

Notifications

With your permission we send push notifications such as room invites, friend requests, and practice reminders. Every category can be switched off in Settings, quiet hours silence all of them, and you can turn notifications off entirely in your device settings.

Intellectual property

The AERSŌMA app, the device, the name, the logo, and our curated content belong to us or to our licensors. You get a limited, personal, non-transferable licence to use the app. You may not copy, modify, translate, reverse engineer, or resell it, except where the law says you may regardless of what this paragraph claims.

Disclaimers

Except where the law does not allow it, the service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the service will be uninterrupted, error-free, or secure.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or lost profits, arising out of your use of the service. Where liability cannot be excluded, it is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

If you are a consumer in the EU, the EEA, or the UK

Nothing in these Terms takes away the rights your own consumer law gives you, and where these Terms conflict with those rights, those rights win.

You normally have 14 days to withdraw from a purchase of digital content. By starting a subscription and getting immediate access, you ask us to begin at once and you accept that the right to withdraw ends once we have. Your statutory rights if something is faulty are unaffected.

You may also bring a dispute to the online dispute resolution platform provided by the European Commission, or to your national consumer body.

Termination

You can stop using AERSŌMA at any time and delete your account in the app. We may suspend or end your access if you break these Terms, or where we must to protect other people or the service. If we end your account without cause while you have paid for Plus, we will refund the unused part of the period.

Governing law and disputes

These Terms are governed by the laws of Texas, United States, without regard to its conflict-of-laws rules, and the courts there have jurisdiction. If you are a consumer in the EEA or the UK, this does not deprive you of the protection of the mandatory law of the country you live in, and you may also bring proceedings there.

Before starting formal proceedings, please write to us. Most problems are faster to fix that way.

Changes to these terms

We may update these Terms. We will post the new version and change the effective date, and we will tell you in the app when a change is significant. If you keep using AERSŌMA after a change takes effect, you accept it; if you do not want to, you can delete your account.
